Terms and Conditions of Dirty Time Landscaping, LLC:
Payment Terms: Payment for services rendered by Dirty Time Landscaping, LLC ("the Company") is due within 30 days of the invoice date unless otherwise agreed upon in writing.
Late Payments: If payment is not received within 30 days, the Company reserves the right to suspend services and apply an 8% interest charge on all outstanding balances.
Legal Action: If payment is not received within 60 days of the due date, the Company reserves the right to pursue legal action to collect unpaid balances. Any legal fees, court costs, or fines incurred in the process will be the responsibility of the client.
Collection Fees: Should the Company need to engage in collection efforts to recover past due balances, any associated fees will be the responsibility of the client.
For Our Snow Maintenance Clients: Dirty Time Landscaping shall not be held liable for any accidents, injuries, or damages that occur on the serviced property, including but not limited to:
- Slip and Fall Incidents: Resulting from snow, ice, wet surfaces, uneven ground, or any other natural or environmental conditions.
- Vehicle Accidents: Including but not limited to collisions, skidding, or loss of vehicle control within parking lots, driveways, or access roads on the property.
- Customer or Visitor Injuries: Any injuries sustained by property owners, tenants, employees, guests, or other third parties while on the property.
- Natural Elements and Weather Conditions: Dirty Time Landscaping is not responsible for hazards caused by ongoing or unpredictable weather changes, including ice reformation, snowfall after service, or naturally occurring hazards.
Limitation of Responsibility: While Dirty Time Landscaping will make reasonable efforts to provide timely and effective snow removal and de-icing, it is expressly understood that:
- No Guarantee of Complete Safety: Clearing snow, ice, and other debris does not guarantee that the property will be completely free of hazards.
Indemnification: The property owner, property manager, and/or contracting party agrees to indemnify, defend, and hold harmless Dirty Time Landscaping, its officers, employees, and agents from and against any and all claims, liabilities, damages, costs, and expenses (including attorney's fees) arising out of or related to any injury, accident, or loss that occurs on the property, except in cases of proven gross negligence or willful misconduct on the part of Dirty Time Landscaping.
Force Majeure: Dirty Time Landscaping shall not be held liable for any failure or delay in the performance of services due to circumstances beyond its control, including but not limited to extreme weather events, government actions, labor strikes, or equipment failure.
Dirty Time Landscaping shall not be responsible for any damage to grass, plants, shrubs, trees, or other landscaping features that occurs as a result of the normal performance of snow maintenance services, including but not limited to snow removal, de-icing, salting, or the use of equipment necessary to fulfill the scope of work.
By engaging with Dirty Time Landscaping, LLC, clients agree to abide by these terms and conditions. Any deviations or exceptions to these terms must be agreed upon in writing by both parties.
